GAC TECHNOLOGY, a simplified joint stock company (SAS) with share capital of €141,285.10, registered in the Lyon Trade & Company Register (RCS) under number 500 168 208 and with its registered office at 26 rue de la Gare – 69009 Lyon, France, specialises in the publication of software for new information and communication technologies. GAC TECHNOLOGY has developed and markets software for use in managing vehicle fleets.
In this context, GAC TECHNOLOGY has developed a mobile app to assist with driving and vehicle management for company car users and/or company car fleet managers using the software (the “Services”).
The MYCARFLEET mobile app (the “Application”) was developed by GAC TECHNOLOGY.
The Application allows all users to connect all of their data when managing their assigned vehicle as part of their duties in the context of managing various actions (expense management, maintenance, reports, vehicle datasheets, expenses, servicing, mileage readings, etc.) exclusively as defined in the Application functions listed in online documentation, provided that the employer has acquired a user licence for software published by GAC TECHNOLOGY from the latter, including access rights for the Application.
The Application is intended for Users who are natural persons, in the context of the duties they carry out on behalf of the Employer holding a GAC Car Fleet account. Users are employees/agents representing the Employer which holds said account and has obtained a GAC Car Fleet software licence in order to manage its vehicle fleet (the “Users”).
Users may be asked to provide personal data, as defined in the General Data Protection Regulation (GDPR 2016/679) (the “Data”) by filling out the indicated fields via the Application when creating their personal account and using the Application.
The words “you”, “your”, “User” or “Visitor” refer to any natural person accessing the Application and using the Service governed by this Privacy Policy.
GAC TECHNOLOGY attaches great importance to the privacy and confidentiality of your information and personal data.
For this reason, this Privacy Policy was drawn up in compliance with applicable laws, regulations and standards and is intended to provide clear, simple and comprehensive information to all data subjects, particularly Users, on how GAC TECHNOLOGY as data controller collects and uses your personal data and how you can influence such use and exercise your related rights. This policy explains what personal data is processed by the Application, how it is processed and for what purposes.
This Privacy Policy is therefore applicable to any person using the Service.
The Application is hosted exclusively by IPGARD data centres located in France.
The data controller for your personal data is GAC TECHNOLOGY, a company registered in the Lyon Trade & Company Register (RCS) under number 500 168 208.
- What personal data is collected?
The following personal data is collected via the Application:
Account information and identification data: GAC TECHNOLOGY collects the User’s name and email address when the User creates their account.
Login details: The User’s full name, login data and usage data are recorded when they log in to the Application.
Profile data: When using the services provided via the Application, Users can fill out their profile data, which may include an address, telephone number, driving licence number and date of birth.
Communication data: User communication data is temporarily saved when the Application is used to communicate with other members or with GAC TECHNOLOGY.
Browsing data: information on the hardware used by Users to access the Application, IP address, connection data, types of web browser and content accessed.
Information collected when using the Service: information on the locations searched for….
Cookies: electronic identification data. Cookies are saved on your device when you use the Application. When downloading the Application, Users can accept or reject cookies.
With the exception of the fields indicated as optional, if you do not complete the mandatory fields, we will unfortunately be unable to process your request. You are therefore free to decide whether or not to provide this information.
- Use of personal data: why is it collected?
Personal data is collected from Users in order to provide and improve the Service via the Application and to maintain a secure environment.
More specifically, such data is used as follows:
To allow Users to access and use the Application: we need your data to create and manage your online account and provide a tailored response;
Providing Users with assistance;
Operational management and Application optimisation: your data is used for analytical purposes. We store and assess data on your recent visits to the Application and how you browse it in order to understand how our visitors use our Application and to make it more intuitive, while optimising the Application’s operation;
Verification, identification and authentication of data submitted by the User;
Communication with GAC TECHNOLOGY;
Detection and prevention of fraud, malware (malicious software) and the management of security-related incidents;
Management of any disputes between the Parties.
- Sharing the Users’ personal data with GAC TECHNOLOGY’s data processors and third-party businesses: who can access your personal data?
Your data is exclusively for GAC TECHNOLOGY’s use. It can only be disclosed to the recipients mentioned hereafter insofar as the forwarding of such data is vital to the attainment of the purposes listed in 2) above.
Users’ personal data may be shared with GAC TECHNOLOGY’s subcontractors and third party companies in the following cases:
If the User authorises a third-party application to access their data;
As part of hosting and maintenance services for customer database(s).
For the purposes of managing the Employer’s fleet of vehicles, if certain data must be forwarded to the suppliers in question.
If GAC TECHNOLOGY uses the hosting or assistance services of external providers, the latter have limited access to the data for the performance of the services and are contractually obliged to use said data in compliance with applicable personal data protection regulations.
If so required by law, GAC TECHNOLOGY may forward data in order to comply with legal or regulatory requirements, court orders, summonses, legal proceedings or administrative and judicial procedures;
If GAC TECHNOLOGY is involved in a merger, acquisition, disposal of assets or insolvency proceedings, it may be required to transfer or share all or part of its assets, including personal data. In this case, Users will be informed before such personal data is transferred to a third party.
- Data retention period
In accordance with law, your personal data is only stored for the period necessary for the performance of the aforementioned purposes and to enable GAC TECHNOLOGY to meet its legal obligations.
Thus, data collected when creating your account and your profile data is kept for as long as you hold a customer account with GAC TECHNOLOGY, while data collected in connection with an order is kept for the period required to complete the order (in addition to legal requirements such as the retention period for invoices).
Personal data used for commercial prospecting purposes may be stored for a maximum of three (3) years as of the end of the commercial relationship.
- Transferring personal data abroad
GAC TECHNOLOGY hereby informs Users that no personal data is currently transferred outside the EU. Processed data is hosted in France or in the European Economic Area.
GAC TECHNOLOGY will comply with legal provisions on the transfer of personal data abroad: the transfer of any data outside the EU will be based on an adequacy decision, governed by standard contractual data protection clauses or by ad hoc contractual clauses with the prior authorisation of the French data protection authority (CNIL).
- Security and privacy:
GAC TECHNOLOGY deploys organisational, technical, software-based and physical techniques in the field of digital security to protect personal data against damage, tampering or unauthorised access. However, it is important to note that the Internet is not a totally secure environment and, as no technology is 100% reliable, the Application cannot guarantee the secure transmission or retention of information sent over the Internet.
All of our staff and service providers are responsible for ensuring the security and protection of your data.
- Exercising Users’ rights
In application of the regulations applicable to personal data, Users have the following rights:
You may request to be informed of how GAC TECHNOLOGY uses your personal data.
You may update or erase your data by writing to: privacy@gac-technology.com.
You can delete your account by writing to: privacy@gac-technology.com.
You may exercise your access rights in order to identify your personal data by writing to: privacy@gac-technology.com. In this case, before complying with this right, GAC TECHNOLOGY may request proof of the User’s identity in order to check accuracy.
If the personal data held by GAC TECHNOLOGY is inaccurate, you can ask to have such information updated by writing to: privacy@gac-technology.com.
Users may request the erasure of their personal data in accordance with the applicable data protection laws by writing to: privacy@gac-technology.com.
You may also withdraw your consent to receive direct marketing messages and object to the processing of your data.
- Amendments to the Privacy Policy
GAC TECHNOLOGY reserves the right to amend this Privacy Policy in any way at any time. If this Privacy Policy is amended, GAC TECHNOLOGY will publish the new version on its Application. GAC TECHNOLOGY will also inform Users of the amendment by email within a reasonable notice period before said amendment takes effect. Governing law
This Privacy Policy is governed by French law. Any dispute or objection relating to the performance or interpretation of these rules which the parties fail to settle out of court will be referred to the competent courts.
